These Terms and Conditions (“Terms”) govern your access to www.wpwebdevpune.com and your use of services offered by WordPress Web Developer Pune (“we”, “us”, “our”), operated by Prasad Tulshigiri from Pune, Maharashtra, India. By using this website or engaging us for work, you agree to these Terms.
1. Services
We offer web development and related services, including but not limited to:

- WordPress development, themes, WooCommerce, and maintenance
- React and PHP applications, headless CMS, and performance optimization
- SEO-ready structure, technical SEO support, and consulting
Specific scope, deliverables, timeline, and fees are defined in a written proposal, statement of work, or invoice—not solely by marketing content on this site.
2. Website use
You agree to use this website lawfully and not to:
- Attempt unauthorized access, scraping at scale, or disruption of the site
- Upload malware, spam, or misleading content through any form we provide
- Misrepresent your identity or infringe intellectual property of others
- Copy or republish substantial portions of our content without permission
Content on this site (text, design, code samples, portfolio descriptions, and branding) is owned by us or our clients/licensors and protected by applicable copyright and trademark law.
3. Inquiries and engagements
Contact form submissions and informal messages do not create a binding contract until we both agree in writing (email proposal acceptance, signed agreement, or paid invoice for defined scope). We reserve the right to decline projects that are outside our expertise, unethical, illegal, or misaligned with capacity.
4. Fees and payment
Unless otherwise agreed:
- Quotes are valid for the period stated in the proposal
- Projects may require an advance deposit before work begins
- Milestone payments may be due on completion of agreed phases
- Late payments may pause work until accounts are settled
- Third-party costs (hosting, domains, premium plugins, stock assets, paid APIs) are typically billed separately or reimbursed at cost with prior approval
Taxes (including GST, where applicable) will be shown on invoices as required by Indian law.
5. Client responsibilities
You agree to provide timely feedback, content, brand assets, and access needed for delivery; ensure you have rights to materials you supply; and maintain backups of your live site where we are not contracted for ongoing hosting or maintenance.
6. Intellectual property
6.1 Your materials
You retain ownership of content and trademarks you provide. You grant us a limited license to use them solely to perform the project.
6.2 Deliverables
Upon full payment for the agreed scope, ownership of custom work product created specifically for you (custom theme code, bespoke designs, and project-specific configurations) transfers to you as stated in the proposal—excluding third-party software, frameworks, plugins, and stock assets governed by their own licenses.
6.3 Our pre-existing assets
We retain rights to general know-how, reusable code libraries, internal tools, and non-client-specific methods developed before or during your project.
6.4 Portfolio
Unless you opt out in writing, we may display your project name, logo, screenshots, or URL in our portfolio and marketing after public launch.
7. Warranties and support
We warrant that services will be performed with reasonable professional skill. Unless explicitly stated in writing, we do not guarantee specific search rankings, revenue outcomes, or uninterrupted third-party services (hosting, DNS, payment gateways, etc.). Bug-fix or support periods, if any, are limited to the duration and scope defined in your agreement.
8. Limitation of liability
To the fullest extent permitted by applicable law:
- Our total liability for any claim arising from an engagement is limited to the fees paid by you for that specific project in the twelve (12) months preceding the claim
- We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption
- We are not responsible for issues caused by third-party plugins, client-supplied content, hosting misconfiguration outside our control, or changes made by you or others after handover
Nothing in these Terms excludes liability that cannot be excluded under Indian law.
9. Confidentiality
We treat non-public business information shared for a project as confidential and use it only for delivery. You agree not to disclose our confidential pricing, proprietary processes, or unpublished work without consent.
10. Termination
Either party may terminate an engagement as set out in the proposal. Work completed up to termination remains billable. Upon termination, we will deliver paid-for work in progress and return or delete your credentials per your instructions, subject to backup and legal retention needs.
11. Indemnity
You agree to indemnify us against claims arising from content or materials you provide, your use of deliverables in violation of law, or your breach of these Terms—except where caused by our gross negligence or willful misconduct.
12. Privacy
Our collection and use of personal data is described in the Privacy Policy.
13. Governing law and disputes
These Terms are governed by the laws of India. Courts in Pune, Maharashtra shall have exclusive jurisdiction, subject to mandatory consumer protections that may apply to you. We prefer good-faith negotiation before formal proceedings.
14. Changes
We may update these Terms by posting a revised version on this page with an updated date. Continued use of the website after changes constitutes acceptance. Active client contracts are governed by the Terms in effect at signing unless both parties agree otherwise.
